Probate

Probate is the right to deal with finances, property and estate on behalf of someone who is deceased.

If there is a will, then the executor has the right to apply for probate. If there is no will, then the next of kin can apply for grant of letters of administration. David Bunn and Co can assist in either circumstance and as part of our all-inclusive process, we will place any required notices, realise all personal and real estate assets of the deceased, pay all of the deceased's debts and then distribute the net estate proceeds to the beneficaries, as per their entitlement.

Please note whilst some solicitors generalise and state that the average time taken to obtain a Grant of Probate is six to twelve weeks and that the average time to complete the administration of an estate is between ten and fifty weeks, the timescale depends upon many factors beyond a conveyancer's control, e.g. the size and complexity of the estate, and the efficiency of HMCTS Probae, the DWP, HM Land Registry, financial institutions, accountants, stock brokers and other third parties.

 

Power Of Attorney

Health and Welfare Lasting Power Of Attorney allows you to choose one or more person to make decisions about your health and welfare, should you become unable to do so yourself.

Property and Financial Affairs Lasting Power Of Attorney allows you to choose one or more person to make decisions about your money and your property, should you become unable to do so yourself.
